Please read these Terms and Conditions ("Terms," "Terms and Conditions") carefully before using the Mahalo Rewards Club mobile application (the "Service") operated by Mahalo Rewards LLC ("us," "we," or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service ("Members").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. General Disclaimer and Use of Service

Mahalo Rewards LLC provides this Service as a directory and resource for our Members and participating businesses ("Vendors"). The Service is a platform to connect Members with offers, promotions, and information provided by third-party Vendors.

We do not own, operate, or control any of the Vendors listed on our Service.

In no event does Mahalo Rewards LLC provide any assurances with respect to a Vendor's operations, business status, or the validity or availability of any offer, discount, or promotion. The Vendor is solely responsible for honoring all offers.

While we make reasonable efforts to keep information up-to-date, we do not warrant or guarantee that any information on the Service (including offer details, pricing, business hours, or vendor status) is accurate, complete, or current. All information is subject to change without notice.

Mahalo Rewards LLC expressly disclaims any liability with respect to purchases or service experiences made based on information or promotions shared via the Service. All Members agree to these general Terms and Conditions by using the Service.

2. Member Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Kamaʻāina Program (Free Service)

The Kamaʻāina program is a free service for Hawaiʻi residents.

  • Eligibility: Access to and redemption of any offer designated as a "Kamaʻāina Offer" is strictly conditional upon the Member presenting a valid Hawaiʻi State ID (or other accepted proof of residency) to the Vendor at the time of purchase.
  • Redemption: The Vendor has the final right to determine if a Member's ID is valid and to honor or refuse the offer. Mahalo Rewards LLC is not responsible for any disputes between the Member and the Vendor regarding offer redemption.

4. Visitor Pass Program (Paid Service)

The Visitor Pass program is a paid service that grants access to "Visitor Exclusive" offers.

  • Payment: We offer one-time, non-renewing passes for various durations (e.g., 30-Day Pass, Annual Pass, Lifetime Pass). These are single, non-recurring charges processed by third-party payment providers (Apple, Google, or Stripe).
  • No Refunds: All pass purchases are final and non-refundable.
  • Expiration: 30-Day and Annual passes grant access for the specified duration from the date of purchase. Your access will expire at the end of this period, and you will not be automatically billed again.

5. Alcohol and Age Policy

The Service lists offers, including Happy Hours, which may involve the sale of alcoholic beverages.

  • Age Restriction: You must be 21 years of age or older to purchase or consume alcohol. Any redemption of an alcohol-related offer is strictly limited to Members aged 21 and over.
  • Verification: Members must present a valid, government-issued photo ID to the Vendor upon request to verify age.
  • Legal Compliance: All sales and redemptions are subject to Hawaiʻi state and local liquor laws. The Vendor has the legal right and responsibility to refuse service to any person. Mahalo Rewards LLC has no liability for such refusal.

6. Participating Vendors

All businesses participating in the Service as "Vendors" have agreed to a separate Vendor Agreement that governs their use of the platform and responsibility for their offers.

7. Limitation of Liability

In no event shall Mahalo Rewards LLC, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • (i) your access to or use of or inability to access or use the Service;
  • (ii) any conduct or content of any third party (Vendor) on the Service;
  • (iii) any product, service, or offer obtained from a Vendor through the Service;
  • (iv) unauthorized access, use, or alteration of your transmissions or content.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
